There are many games 2D platform that have been floating around the net for a while, but just as wonderful and interesting look like

The main mechanical

Owlboy is clearly a labor of love and a tribute to an era of past games. Last fall, a demo was released for the game, win those who are frustrated with delays long constant part. Dtoid Joseph Leray was one of them: They eat pure, the pure joy of being free from gravity. And he manages to merge a half dozen systems (admittedly simplified) in a game with few hiccups.

So why is it taking so long?

Simon Andersen, artist and director:
"We are on Miyamoto's development philosophy:" A set of delay time can be good, is a bad bad game forever. "

had a lot of times when you could lay their hands and did something that was only half the pride. But that's not why we do games in the first place. Everyone on our team wanted to create something special.
At the same time, we decided to upgrade our tools to do things the way we wanted. Now we have our level editor, a new scripting system and created an animation that can be rotated segments to encourage patrons giants using only a few pieces. In other words, it was as if the game was pretty good, so we sat down and actually pretty good.
I hope that when people really have a chance to play our game, the wait will be worth it. "

Share of equipment sold nudges 50%, but analysts said it could reach a ceiling - for all Windows Phone Nokia devices starting to make inroads

Android is back on the cruise control at the top of the smartphone market in the UK, after a surge in sales of Apple iPhone 4S dented his lead over Christmas.

New figures from Kantar Worldpanel ComTech covering the 12 weeks to 19 February 2012 that Android phones made up 48.5% of smartphones sold, as the proportion of smartphones combination of all mobile phone sales increased to 73.2%.

However, the smartphone industry is in turmoil, with the company's data show that over half (51.6%) of people who bought a smartphone in this period and had a - at least half were purchased by phone users download feature of the new platform. In addition, switching between platforms like Android, BlackBerry-maker RIM, Symbian, and Apple IOS is common: more than half (54.1%) of smartphone owners who bought a new platform changed.

Sunnebo

But Sunday, the Director of Global Consumer Insights ComTech Kantar said that Android may have peaked. "We saw you run around the mark of 45% -50% for months, but there is no sign that goes on it," he told the Guardian.

He thinks the easy prey to have previous smartphone owners who have left the platform of Nokia Symbian - "has virtually disappeared from the market" - means that in the future, the fight hand market being much more competitive.

sales, after rising 34% in 12 weeks to 26 December 2011, fell to 28.7% - even if it is greater than 22.7% did so during the same period in 2011, when both Android platform and BlackBerry RIM were ahead.

RIM

increased slightly compared to 12 weeks of December, from 16.1% to 17.1%.

Together, the three platforms constituted 94.3% of smartphone sales. The figures do not include sales to businesses, and therefore probably underestimate the sales of RIM, said Sunnebo. Overall, the company estimates that 51.3% of the UK population now has a smart phone.

Customers using smartphones expressed greater satisfaction with their devices than phones that use films, according to the panel. In the range of 0 to 10 (10 being the highest score) mean smartphone users was 7.9, against 6.9 for mobile films.

We wrote in the past about how the three main producing countries in world cinema are Nigeria, India and China - although all three have extremely high rates of violation. Seemed to offer the perfect counterpoint to the insistence of the MPAA that piracy rates high automatically lead to the destruction of all forms of film industry. In fact, research has also shown that the amount of piracy in Nigeria was in fact a large part of why Nollywood has been so successful. The ability to let "hackers" to distribute their movies in the most efficient way possible to say that the films were distributed throughout Africa and established Nigeria as the place to make movies.

course, as seen through the history of development of various industries, it is always

after aa the industries are established and fast growing current players want a sudden rise of intellectual property laws to trample a new competition. This is true in most of the history of intellectual property rights, and shows that these laws are not - as we are told - on creating incentives to invest in these industries, but rather to maintain competition and the creation guards lock things for established players. The same thing is happening in Nigeria as well, as there have been new efforts to stop the offense, despite being so central to the importance of the emerging industry.
Although we covered this before, Eric Crampton points our attention to a new research paper that looks further into this story:

The Rise of Nollywood: designers, contractors, and Olufunmilayo Arewa Pirates. Covers much of the earth as our previous reports, first highlight the usefulness of the offense on the establishment of industry - that appears to employ more people in Hollywood. In fact, the most surprising is that while many developing countries focus on government subsidies, insisting that it is the only way to build a local film industry, almost no government support in Nigeria, However, the industry is much larger than comparable countries:

The increase of the film industry in Nigeria goes against trends in the film industry in developing countries, which produce 1.2 million per film capita per year, within developed countries, the production of films of 6.3 per million population per year. At current levels of production of Nollywood, Nigeria produces about 6.7 movies per million population per year. Narrowing the gap film production in developing countries remains a challenge, especially since the best ways to create national film industries remains difficult in many cases.
Before the proliferation of Nollywood films, at least one commentator suggested that the government takes the movie industry would be the only means by which Nigeria could develop a film industry.

note that although many countries have tried to encourage particular types of film production through a direct government funding, grants or protection schemes on the film titles of films, many of these industries have not been commercially viable without subsidies or other support programs.
In contrast, Nollywood has created a large amount of local video movies with virtually no government involvement and subsidies. Nollywood's success in many ways may be due to lack of participation of government and its decentralized nature, allowing participants to be very enterprising Nollywood, adaptable and innovative. Nollywood can now employ over 200,000 people directly with estimates of indirect employment of up to 1 million. The market-oriented approach of Nollywood is cheaper than existing models of production and distribution of films and can provide a new model for developing countries wishing to develop national film industries.
In fact, part of "market driven" approach is to understand how to embrace and enjoy the widespread violation. This helped to set up quickly and inexpensively (free) distribution and promotion of new films. He also continued to promote interest in the new movies that people want to continue to see more, helping to keep the industry going.

In an excerpt from his new book, William Poundstone believes that logic puzzles, riddles and trick questions during interviews surprising that Google is notoriously difficult. Do they do through the next round?

live in a time of despair. Never in the life of the memory competition for employment has been more intense. It has never been harder job interviews.

For some job seekers, Google is the shining city on the hill. This is where the smartest people make things more interesting. In the U.S., Google consistently ranks at or near the top of the list of Fortune 100 Best Companies to Work For. But companies are also unsexy with several qualified candidates for each position. That's great for companies that are capable of contracting. Like Google, just to skim the best talents in their fields. Not very good for the plaintiffs. They face a hard, rough, more invasive testing.

This is most evident in the interviews. There are, of course, many traditional types of questions asked during job interviews. These include the "behavior" issues that have become almost clichés: "What is your greatest failure in life?" Questions about the company: "How would you describe Holland & Barrett to a person who came from another country?" And finally, there are open challenges such as mental how they weigh an elephant without using a ladder, something that Google is known primarily an attempt to measure mental flexibility and potential, even business. The answer? Push the beast with a barge. The weight of the barge will be elephant to sink several inches into the water. Draw a line on the hull of the barge to mark the water level. Then direct the elephant in the ground. Loading of the barge of 100 pounds of sand bags (or anything useful) up 'that it runs at the line marked on the hull. The elephant weighs as much as sand.

The Google interview style is indebted to an older tradition of using logic puzzles to test applicants for technology companies. Consider this: The interviewer writes six numbers in the boardroom - 10, 9, 60, 90, 70, 66. The question is, what number comes next in the series?

most of the time the job seeker must face, bravely trying to make sense of a series that provides all information to be totally meaningless. Most of the candidates to give. Some are lucky a flash of intuition.

Forget the math. Specify the numbers in plain language, which gives the following: 1009 90 66 sixty sixty. The numbers are in order of number of cards that are in their names. Ten is not the only number that can be written with three letters. Years ago one, two and six. Nine is not the only four-letter, a nonzero digit, four and five. This is a list of the largest numbers that can be written in a number of letters.

Now, for the payment, what number comes next? Whatever the number is 66 must have nine letters in it (not counting a possible scenario) and must be the oldest of nine card number. Play with him and is likely to reach 96. Does not look like you can get something over 100, because it begins "a hundred" that requires 10 points or more. You might wonder why the list is 100 (one hundred) instead of 70 (sixty). "Millions" and "billion" have seven letters, too. A reasonable estimate is that they are using cardinal numbers written in proper English style manual. How to write the number 100 is "one hundred".

In many of these companies, the only correct answer is 96. At Google, 96 is considered an acceptable response. A better answer is 10,000,000,000,000,000,000,000,000,000,000,000,000,000, 000,000,000,000,000,000,000, 000,000,000,000,000,000,000,000,000,000, 000,000,000. Aka "a googol".

This is not the best answer, though. The preferred answer is 100,000,000,000,000,000,000,000,000,000,000,000,000,000, 000.000, 000,000,000,000,000,000,000,000,000,000, 000,000,000,000,000,000,000,000. Ten googol.

puzzles like this can have drawbacks as interview questions. The answer here is a simple matter of perspective: you either get it or not. There is a process of deduction that are linked, and therefore no way to tell someone to solve the problem of someone who already knew the answer. Google, of all places, persons applying for a job knows how to use a search engine. Candidates are expected Google to get Google interview advice, including questions. Accordingly, Google encourages its investigators to use a different type of question, more open, with no definitive "right answer".

You and your neighbor has the next car boot sale the same day in one place. Both will sell the same item. You will put your item on sale for £ 100. The neighbor will be selling in less than 40 pounds. The articles are in the same position. What do you do, assuming you are not in a position of special friendship with the neighbor?

What

not to be on good terms, especially if you say that a strategic response is expected. As if the fact that this question is asked frequently in the Wall Street houses the most aggressive. The solution is to get the friendly neighbor to the side and say, "You lose money, provided for 40 pounds." But this plan is not considered a particularly good response. Suppose that the general spender are two identical items are on sale for £ 100. It is equally likely to choose either to be sold.

I just want the neighboring element

market. You can offer to pay the neighbor not to market your product. A better answer is simple: purchase the item from a neighbor. He will be happy to sell your product immediately. It is not likely to be offended or increase the price. You can haggle, like any other buyer, and you can get for under £ 40. Why would you want your subject? When you put something on sale for ? 100, you expect to get a decent profit to compensate for the time you invested in your sales and factoring in the possibility that it will sell. Anything that reduces the possibility of selling their product in fact it costs a significant fraction of which £ 100.

The numbers in this puzzle were chosen so that the price of the neighbor is comparable with the economic damage is done to you. To purchase the item, you get the right to keep the weight on the market when it suits their purposes, over the right to sell at whatever price the market will bear. All you get by selling the second point is pure profit. The best plan is to hide an item until the first sale. Then place the second point of sale at a reduced price, according to the latest time of day it is.

As the labor market collapsed in 2008, employers took his career, or just telephone interviews where the interviewer asks questions called a filter or evidence of fire. These are simple questions or criteria that (supposedly) eliminate the "bad" people. Many companies trivia about the company. Morgan Stanley asked respondents to name a recent history they have read in the Financial Times - apparently, many can not -. O to give the square root of 0.01 (which is 0.1)

Bloomberg LP is great for proofreading. Some candidates are tested that must count the number of occurrences of a certain letter, upper or lower case, in a paragraph. It is much harder than it looks. (Do not you think? Counting the hours in this paragraph. Some 15 years ago, and almost nobody gets them all.)

"If you were a cartoon character, what would you be and why?" This is a question that Bank of America has asked candidates to personal bankers. "I told Yogi Bear," recalled one of the applicants. "I do not remember why I said it, but hiring managers applaud everything." He gave the position immediately. Such questions sometimes downright stupid, became more frequent. How to be a math whiz or technology is not relevant to the performance of most companies, large companies have increased their efforts to find the perfect combination of candidates and legal personality. An online retailer has asked, "On a scale of one to 10, chances are you? "The preferred answer is somewhere in between, CEO Tony Hsieh said. One is" probably a little too puritanical for us "and 10" may be too psychotic " .

The best answer: the empty box of drawing pins. Take the lid of the box, go back down and tack on the wall. The box outside of key projects as a small drawer. Then put a sticky hold a candle to the bottom of the box. Tactical point, projecting through the bottom of the box serves as a deer. Finally, drag the bottom of the box at the top of the wall box. The upper and lower nested be stronger than either alone, and bear the weight of the candle.

The great physicist Richard Feynman once applied for a job from Microsoft (so goes the apocryphal story guaranteed). "Well, well, Dr. Feynman," began the interview. "We have many Nobel laureates, including Microsoft. But before you can hire, there is a slight formality. We need to ask a question to test your ability to think creatively. "It's a ridiculous question," said Feynman. "On the one hand, all covers are round. Some are square! "

The data provided in response to a statement from Oracle suggests that Google is becoming more recipes using ads and Android iPhone applications

Android

generates less than $ 550 million revenue from Google between 2008 and late 2011, if the figures provided by the search giant as part of a settlement offer before trial with Oracle violation patents and copyrights should be an accurate guide.

The figures also indicate that Apple devices like the iPhone, using products like their maps and Google search in Safari browser, has generated more than four times more revenue for Google in their own phones with the same period.

With nearly 200 Android devices were activated at the end of 2011, including an estimated 90m over the last two years suggests that Google gets a little more than $ 10 per year for the Android phone .

That compares with $ 38 billion in total revenues of Google in 2011, almost entirely from advertising on computers, which are installed around the world 1.25 billion, according to Microsoft. This suggests an average income of Google for about $ 30 per PC per year, but not everyone will be able to access the Internet or use Google, so the actual figure will be higher.

Google has never published the figures of revenue resulting from the use of Android phones, making the software available to handset manufacturers for free and get revenue from ads and sales requests. The company declined to comment on the calculations of the Guardian, which was shown prior to publication.

The figures come from the compensation offer Google made to Oracle as part of the settlement discussions ordered by Judge William Alsup in the case, in which Oracle is based on Android infringing patents and rights who owns the copyright in the Java programming language. Intellectual property acquired when it bought Sun Microsystems, the owner of Java, in 2010. The trial is scheduled for April 16.

The trial began in 2010 with Oracle claims that Android violates a series of patents from Sun and also violates the copyright in Java. The number of patents has been reduced to two.

In a settlement offer before trial, Google suggested that Oracle would pay a percentage of sales of Android, suggesting that it would pay $ 2.8 million in damages interest in the other two Oracle is seeking patents for the period 2011 and 0.5% of Android steady income in a patent that expires in December, and 0.015% in another, which expires in April 2018. The court documents (PDF) do not explain how income is calculated for Android, but the main source is advertising revenue. Google also reduced by 30% of sale applications for Android devices.

Google said the numbers correspond to what damage has been estimated by an expert appointed by the court. The offer does not mean that Google admits that he violated the patents claimed by Oracle.

The offer of $ 2.8 million, at a combined rate of 0.515%, suggests that the total income of Android since the launch of the first phones in late 2008 through 2011 was of $ 543m. Payments for patents for mobile phones are usually at a fixed price for all mobile phone license which is alleged to infringe the patents in question.

In turn, the comparison of total income of Android court documents indicate that the IOS has generated far more revenue for Google ecosystem of your own handset.

Oracle
Google rejected the offer, saying the proposed damages were too low.

The lawsuit was initiated after Oracle bought Sun Microsystems for $ 7.3 billion in 2010 and with it the rights of the Java programming language and patents. Oracle complained that Android in effect, a copy of the Java functions without a valid license.
Oracle, a software company with $ 36 billion in annual sales, said he is seeking hundreds of millions in damages - even though he was forced to soften his earlier claims, after the examination of custody has led to a number of patents applied in Java be invalidated.

The original judgment in the case of Viacom against YouTube is a complete and total victory for YouTube. The court effectively dumped the case on summary judgment stage, it is recognized that qualified for YouTube DMCA safe harbors, and Viacom has been trying to change the clear definitions in the safe harbor provisions. This maximalist copyright of many evils, and we heard stories about how the decision would not survive appeal. To some extent, that was correct. The ruling came today in the call, and certainly that walk back to the original sentence, but overall still advice

position to YouTube.
The key issue at trial revolved around the question of knowledge called "red flag" - and if that meant that the specific knowledge that they were infringing items ( such as YouTube and the trial court believes) or just the general knowledge of the infringement on the site (as argued by Viacom). In this case, the Court of Appeal correct in saying that expertise
necessary.

Although the parties raise several arguments on appeal, is the text of the law which compels our conclusion. In particular, we believe that the basic operation of § 512 (c) requires the knowledge or awareness of the specific activity of the offense. Under § 512 (c) (1) (A), knowledge or awareness is not enough to disqualify the service, but the vendor who wins the knowledge or awareness of infringing activity port protection kept safe if it "acts expeditiously to remove or disable access to the area." 17 USC § 512 (c) (1) (A) (iii). Therefore, the nature of the obligation to withdraw provides knowledge or awareness of offender specific hardware, because the rapid expulsion is possible only if the service knows in detail the items to delete. In fact, at the request of the rapid elimination in the absence of knowledge specific or awareness would be to require the amorphous obligation to "take commercially reasonable measures" in response to a widespread awareness of the offense. Viacom 33 Br. This view can not be reconciled with the language of the law, which requires "prompt []" action to remove or disable
"hardware" in question. 17 USC § 512 (c) (1) (A) (iii) (emphasis added).

The court rightly rejects the idea that the "red flag" of knowledge of the DMCA means that knowledge that there is a violation - without knowing the details - means you lose the safe harbor. Since this is the key issue in the application, it is good that the court Appeals that right. It was also the point that the maximalist insisted that no appellate court to defend, and clearly they were wrong in this regard. the Court responds to the request that red flag, if knowledge does not apply to "general" knowledge of the offense, then it is superfluous to point out that not true:

The difference between the actual knowledge of the red flag and is therefore not between general and specific knowledge, but from a subjective and an objective criterion. In other words, by providing actual notice depends on whether the actual supplier or "subjectively" aware of the particular violation, while providing turn red flag if the supplier was subjectively aware of facts that would have made a specific offense "objectively" obvious to a reasonable person. The red flag available, because it incorporates an objective standard, which has not been devoured by providing information under our true construction of § 512 (c) safely. These two provisions are self-employment, and they apply only to specific cases of violation.

In other words, it is possible to prove that there are red flags, but they should be red flags for violations of

specific elements

, not knowing that there is no offense in general. This is a good decision and make sense. accept the interpretation of Viacom would have effectively killed much of the DMCA. interpretation of YouTube (now supported by the district and appellate court) maintains the tolerances of the DMCA in the existence.

said, the court indicates that the district court may have erred in granting summary judgment on this point. In this case, the court speaks specifically on the actions of YouTube, Viacom, saying that at least raises enough questions that it is possible to argue that YouTube, in fact, aware of
aa specific

counterfeiting . In other words, the court agrees to the big picture interpretation
of the law, but disagree on the specific application
by the district court. This does not mean that the court considers that YouTube violates the DMCA - that Viacom, at least raised questions that should be adequately treated by a jury in a trial, rather than decided at the summary judgment stage. So, the case will go to the District Court to be heard on this issue.
