Over the years, We've Been Threatened with Lawsuits defamation times more Than I'd like to recall, though nothing you've ever come of Any of Them (even the latest Threat, Which Seemed more likely to end up in court Than others). Apparently, we're not alone. Highly questionable Filing Lawsuits defamation is the hot new Hollywood Apparently trend.
Everyonesomeoneis in action. Of course, almost all of these demands are unlikely to get very far. Defamation of a public figure must involve "actual malice" rather than just false statements, and is quite rare for any of the statements rise to that level. And, really, so many of the claims seems quite ridiculous that anyone, in which nobody is really taking it seriously. Take, for example, the last of Lindsay Lohan defamation suit against rapper Pitbull ridiculous to include the line: ". I have locked up like Lindsay Lohan" Lohan lawyers claim that this "derogatory or defamatory" lyric is "intended to cause irreparable harm. "Really? Nobody put these things through a filter of reality?
Of course, Lohan is also the celebrity who once sued E * Trade for $ 100 million, because one of your ads referring to ababycalled "Lindsay", which was described as a "milkaholic". There is nothing in the ad implied that this baby "Lindsay" had something to do with Lohan. However, it still demanded.
Like other laws, the fundamental cause of defamation laws seem to make much sense. If someone is going to publish or say things about you totally false, should not have any recourse? But, as we will see more and more of these ridiculous claims, I'm beginning to wonder if the law of defamation that really makes much more sense. It made little sense when there were gatekeepers for information to the world. If a newspaper lied about you and no way to get your answer published defamation suits that could help solve. But today, anyone can publish and anyone can speak. In fact, there are stories of all time "big bad things" that people or companies do to others.
In an age where most of the porters are disappearing, it seems that the response to defamatory speech should be "more speech", except in extreme cases. However, despite the "actual malice" should prevent most of these games, we have dozens of lawsuits so that seems to be because someone's feelings get hurt. That's not what the law of defamation in question and that is closer to such claims should benefit from anti-SLAPP sanctions, which too often appear to be attempts to get something to someone saying "not nice" to be shut up.
