If there is no such thing as a system of copyright in the operation, one of its principles should be that it is very easy to know if what you do is an offense . Of course, as we have discovered again and again, people unkowingly violates all the time - and not just due to negligence or ignorance. Often it is because it is simply impossible to know. Take, for example, the common practice of raising a version of a song on YouTube. This is all the time
. Many people sign up to sing popular songs and put them on YouTube. According to Andy Baio, about 12,000 of these cover songs are downloaded every day. Justin Bieber became the cause of some YouTube videos of him singing songs from someone else.
But is it breaking the law?
Andy Baio dug
this issue and found it almost impossible to determine. Now, if you are just record a cover of the release, are not mandatory / mechanical license fees can be used. That's why you see in the albums of cover songs all the time. It is made with "permission", but rather because someone pays the statutory rate set by the government. The problem, however, when added to the video mixing. Once we are talking about a video clip, a second license to be fixed: the synchronization license. And there is no compulsory license synchronization costs - meaning that the owner of copyright can (and often do) charge exorbitant prices if they match your request to all.
The end result? It is likely that quite a few videos of songs downloaded each day of coverage is breaking - perhaps opening up huge fines chargers for violating the laws of copyright. This is a clear sign that the law is broken. The law clearly states that are not intended for this type of situation, and is easily correctable. Baio made the point that this is an easy to reform copyright law to decriminalize a common behavior:
The real question: Why is it illegal in the first place?

covers on YouTube are, almost everyone, not commercial. They are created by fans, for most amateur musicians, with a negative impact on the market value of the original work. (In all cases, the request by acting as a promotional vehicle free of the track.)
The best solution is the most difficult: To reform the law of intellectual property to legalize the distribution of free, non-commercial coverage of songs,.

However, as noted Baio, Google
fact
sign an agreement with the National Association of Music Publishers, which will for publishers to join a program where you get some money to allow their songs to be played by others on YouTube. But nobody knows who is actually publishing rights covered by this Agreement, it is really unnecessary.
