U.S. Federal Trade Commission initiative could see the giant search process that faces the Atlantic
The United States Federal Trade Commissionpreparing a lawsuit against Google, which could lead to a complete combination similar to the antitrust action against Microsoft in the 1990s, the Guardian has learned.
initiative means that Google may face antitrust proceedings on both sides of the Atlantic, its two largest markets -. Potentially stop its expansion into new areas of activity
The New York Times reported Friday that the FTC is preparing a folder with a thesis project running over 100 pages asks whether Google manipulates its search results to favor its products, if this makes it more difficult for its competitors' products to feature prominently in the results.
FTCsources have confirmed to The Guardian that its staff are preparing the case, which could lead to a confrontation between the U.S. government and research firm. The agency has investigated Google for over a year, looking at the position in the search market in the United States, and how they use this position in relation to its other products like buying Google Google places.
This echoes the great battle antitrust took place between Microsoft and the Department of Justice in 1998, when the U.S. software company has been accused of using its monopoly Windows operating system for boost your Internet Explorer browser to the detriment of competitors such as Netscape.
The European Commission is negotiating with Google for similar facts that the American company, which has a much larger share of the search market in Europe and the United States, promotes its own products compared to its rivals YouTube to determine search results. Google's market share is 90% in Europe, about 65% against the United States.
Competition Commissioner Joaquin Almunia said in September that if the negotiations fail, the Commission could take Google to court for antitrust issues. The two parties negotiated for the summer.
- Shivaun Raff, who heads the British engine Foundem vertical search, and was one of the original complainants in the commission, told the Guardian: "The damage caused by the preferential placement of Google is not only about consumer deception is mainly a question of the ability to crush the competition Google to divert large volumes of traffic and services tax outside competition and hers. For this reason, a clear and obvious labeling alone will not solve the problem. " There is no specific timetable for an agreement between Google and the Commission.
Google told the New York Times. "We are happy to answer any questions that regulators have on our business" In an antitrust case to succeed, the U.S. government would have to prove that Google has a monopoly in a field - is almost certain to find - and I tried to use this monopoly gain market share in another area at the expense of its rivals. In addition, it should be demonstrated that consumers have been harmed by the second action.
If Google is found to have a monopoly on research and use it to expand into other markets may be subject to a control system similar to Microsoft antitrust had to work more a decade. However, before the FTC can pursue the matter, most of its five commissioners agree that he has a case to answer.
